1 About Rush Buzz

Rush Buzz (Pty) Ltd ("Rush Buzz", "we", "us", "our") provides a business automation platform that helps South African small businesses manage bookings, run email campaigns and automate client workflows. Our platform is accessible at rushbuzz.co.za and app.rushbuzz.co.za.

2 Acceptance of Terms

By accessing or using Rush Buzz, you confirm that:

• You are at least 18 years of age
• You have the legal authority to enter into a binding agreement on behalf of yourself or your business
• You have read and agree to these Terms of Service, our Privacy Policy, and any additional terms applicable to your subscription plan

These Terms constitute a legally binding agreement between you ("you", "user", "subscriber") and Rush Buzz (Pty) Ltd, governed by the laws of South Africa including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), and the Protection of Personal Information Act 4 of 2013 (POPIA).

3 Accounts & Registration

To use Rush Buzz you must create an account. You agree to:

• Provide accurate, current and complete registration information
• Maintain and promptly update your account details if they change
• Keep your password secure and not share it with any third party
• Notify us immediately at info@rushbuzz.co.za if you suspect unauthorised access to your account
• Accept responsibility for all activity that occurs under your account credentials

Rush Buzz reserves the right to refuse registration or suspend any account at our discretion.

4 Subscription Plans & Pricing

Rush Buzz offers the following monthly subscription plans, billed in South African Rand (ZAR):

All prices are inclusive of VAT where applicable. Rush Buzz reserves the right to adjust pricing by giving subscribers at least 30 days' written notice via email. Continued use of the platform after the notice period constitutes acceptance of the revised pricing.

Features included in each plan are detailed on the Pricing page and are subject to change. We will notify you of material feature changes in advance.

5 Free Trial

Rush Buzz may offer a 14-day free trial on eligible plans. The following conditions apply:

• One free trial per person, email address and business — duplicate accounts to obtain additional trials are prohibited
• A valid payment method may be required to start your trial. You will not be charged until the trial period ends
• If you do not cancel before the end of the trial period, your subscription will automatically convert to a paid plan and your payment method will be charged at the applicable monthly rate
• Rush Buzz reserves the right to modify or discontinue the free trial offer at any time without notice

6 Billing & Payment

Subscriptions are billed on a recurring monthly basis. Your billing cycle begins on the date you first subscribe (or when your free trial converts).

Payment processing

All payments are processed by PayFast (Pty) Ltd, a PCI DSS compliant payment gateway. Rush Buzz does not store your card number or banking credentials. By subscribing, you also agree to PayFast's terms and privacy policy.

Failed payments

If a payment fails, we will attempt to notify you by email. Access to your account may be suspended until payment is successfully processed. Rush Buzz reserves the right to terminate the account after repeated unsuccessful payment attempts.

Invoice & receipts

Electronic receipts will be sent to your registered email address after each successful payment, in accordance with the ECT Act.

7 Cancellations & Refunds

Cancellation

You may cancel your subscription at any time from within your account settings or by contacting us at info@rushbuzz.co.za. Cancellations take effect at the end of the current billing period — you retain full access until that date.

Refund policy

Exceptions may be considered in cases of:

• Duplicate or accidental charges — contact us within 7 days of the charge
• Documented technical failures that rendered the platform completely unusable for an extended period, at our sole discretion

All refund requests must be submitted to info@rushbuzz.co.za. This policy does not limit any rights you may have under the Consumer Protection Act 68 of 2008.

8 Acceptable Use Policy

You agree not to use Rush Buzz to:

• Send spam, unsolicited bulk email, or any communication that violates the ECT Act or applicable anti-spam legislation
• Upload, transmit or store any unlawful, harmful, defamatory, obscene or fraudulent content
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorised access to any portion of the platform or its related systems
• Reverse-engineer, decompile, copy or create derivative works from any part of Rush Buzz
• Collect or harvest personal information of other users without their consent
• Use the platform in a manner that violates POPIA or any other applicable South African law
• Resell, sublicense or commercially exploit the platform without written authorisation from Rush Buzz

Violation of this policy may result in immediate suspension or termination of your account without refund.

9 Intellectual Property

The Rush Buzz name, logo, mascot, platform design, software, code, written content and all associated intellectual property are owned by or licensed to Rush Buzz (Pty) Ltd. Nothing in these Terms grants you any ownership interest in our intellectual property.

You retain full ownership of all content and data you create or upload to the platform ("Your Content"). By using Rush Buzz, you grant us a limited, non-exclusive, royalty-free licence to use Your Content solely to operate and provide the service to you.

10 Your Data & Privacy

The collection, use and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to compliance with POPIA.

You are responsible for ensuring that any personal information you enter about your clients (names, email addresses, contact details) is collected and processed in accordance with applicable law, including POPIA. By using Rush Buzz's email and automation features, you warrant that you have the necessary consents or lawful basis to contact the individuals in your client lists.

11 Disclaimers

Rush Buzz is provided "as is" and "as available". To the maximum extent permitted by South African law, we disclaim all warranties, express or implied, including:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Any warranty that the platform will be uninterrupted, error-free or completely secure
• Any warranty regarding the accuracy or reliability of results obtained through the platform

We do not guarantee that emails sent through the platform will be delivered or that automated workflows will execute without error in all circumstances.

12 Limitation of Liability

To the fullest extent permitted by law, Rush Buzz (Pty) Ltd, its directors, employees and contractors shall not be liable for:

• Any indirect, incidental, special, consequential or punitive damages arising from your use of the platform
• Loss of revenue, profits, data, business opportunities or goodwill
• Any damages arising from third-party services, including PayFast, Supabase or EmailJS

Our total aggregate liability to you for any claim arising from these Terms or your use of the platform shall not exceed the total subscription fees paid by you in the 3 months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited under South African law.

13 Indemnification

You agree to indemnify, defend and hold harmless Rush Buzz (Pty) Ltd and its officers, directors and employees from and against any claims, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the platform in violation of these Terms
• Your violation of any applicable law, including POPIA or the ECT Act
• Any content you upload, store or transmit through the platform
• Any claim by a third party that Your Content infringes their rights

14 Termination

By you

You may close your account at any time. Closing your account cancels your subscription effective at the end of the current billing period. After termination, your data will be deleted within 30 days in accordance with our Privacy Policy (billing records are retained for 5 years as required by law).

By Rush Buzz

We may suspend or terminate your account immediately and without prior notice if:

• You materially breach these Terms and fail to remedy the breach within 7 days of written notice
• You use the platform for any unlawful, abusive or fraudulent purpose
• Continued provision of the service would expose Rush Buzz to legal liability
• You repeatedly fail to make payment when due

Where permitted by law, a terminated account may not be entitled to a refund of any prepaid subscription fees.

15 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, with particular reference to:

• Consumer Protection Act 68 of 2008
• Electronic Communications and Transactions Act 25 of 2002
• Protection of Personal Information Act 4 of 2013

Any dispute arising from or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be severed and the remaining provisions shall continue in full force and effect.
